No Trading Fees Terms & Conditions
1. Overall agreement.
1.1 General
Notradingfees.com is a trading name of Chocolate Finance Limited whose registered company number is SC339675.
Access and use of the Notradingfees.com website is subject to the following terms and conditions of use ("Terms of Use"). Before carrying out any transactions on the Website, you must read the Terms of Use. By proceeding with the transaction, you are deemed to have read and understood the Terms of Use and you signify your acceptance of the same.
From this point on, notradingfees.com and all associated web pages, its owners, employees and administrators shall be collectively known as “NTF”.
Users, customers or clients shall be known as “client”. Any disputes arising out of this agreement shall be governed by current Scottish law. Use of the services provided by NTF in any other country shall still be governed by Scottish law. Also, the following terms and conditions are applicable regardless of which country you access or use the services in and must be adhered to at all times.
As a registered NTF site member, you may freely browse all available markets and buy and sell any virtual stocks available depending on the number of credits you won within the site.
NB All data is protected by the Data Protection Act 1998.
1.2 This agreement.
This agreement is a legally binding document which sets out NTF’s rights and responsibilities to you the user regarding the services available at http://www.notradingfees.com/. Registration is free but by registering, you become an NTF Member and re-affirm this agreement every time you use the services. If you do not agree to all the following terms and conditions, you may not use the services herein. By registering with the NTF site (http://www.notradingfees.com/), you agree to and accept all of the T&C contained herein, including the Privacy Policy (section 3) and any other T&C referred to. Please note that such references are made via the underlined, highlighted words which are links to those subjects which must also be agreed to in order to gain full membership of NTF services.
This agreement is effective as of March 1st, 2006.

1.3 Changes to this agreement.
This agreement may be updated and changed at any time without prior notice. Current users shall be informed via a link on the homepage at http://www.notradingfees.com/ and shall be governed by the new T&C 14 days after the updates or changes. Any users joining after such changes or updates shall be governed by the new full T&C. If you do not wish to be governed by the latest version of the agreement, you must notify us within 14 days of the changes and cease further usage of the services.
1.4 Accuracy
At NTF, we do our best to ensure that any information, data, services, systems, articles, bulletins and other content published from time to time on the website is accurate and complete. However, neither we nor our suppliers warrant that the any content is accurate or complete.
Furthermore, certain information on the website is provided by third parties and you acknowledge that neither we nor our suppliers have any control over the accuracy or completeness of such third party data.
We therefore recommend that you check the accuracy and completeness of any content with an independent financial adviser before purchasing any NTF credits or placing a trade, either a buy (bid) or a sell (ask) order on any of the virtual financial products or services.
1.5 Advice
The Content of the Website is intended for general information only and should not be construed as advice under the Financial Services and Markets Act 2000. We recommend that you take appropriate professional and legal advice before entering into any binding contracts.
All prices and information quoted on the Website are indicative rather than definitive. The Website itself does not constitute an offer to buy or sell real shares or provide any real financial products or services, nor does the Website comprise any form of investment advertisement. It does however, offer prices to buy or sell virtual prices in virtual products as set by the users, employee and administrators of notradingfees.com. These products are in no way backed by any shares traded on the London Stock Exchange and similar names are for information purposes only. Any trades in virtual products on notradingfees.com are based on agreements between users to buy and sell certain prices and thus profit or loss based on the difference between the buying and selling prices at which a user executes their trades in any particular virtual share. Such trades in no way constitute a purchase or a sale of real financial products.
2. Registration and Legally Binding Contracts.
On registering with NTF, you agree to supply correct and accurate details including your name, address, telephone number, email address and any other requested details. Any false information you supply will be deemed fraudulent and be judged a material breach of this contract. NTF takes no responsibility for any false information you supply and shall not be held responsible for any breach of these T&C.
You accept that if you enter into a contract with another user either to buy or sell virtual financial products through the NTF website via clicking any buttons which allow you to buy or sell, the contract is legally binding and you will be responsible for honouring this contract under Scottish law.
If you do supply any false information or are not legally eligible to buy or sell through the NTF website, you accept that you are personally liable should any legal action be taken and NTF shall be held entirely blameless and shall not be held liable in any way, shape or form.
You accept that if another user should supply false information or does not have the right to buy or sell on virtual financial products and this affects you in any way, you shall hold NTF completely blameless and agree that if you are to take any legal action against the guilty party, NTF shall have no involvement and will not be held liable in any way, be it financially or otherwise.
3. Privacy Policy
3.1 Your Personal Details and Data Protection.
As NTF gathers your data and personal information, you want to know that it is safe. NTF uses the very latest in encrypted software and secure servers to make sure your data is secure. However, as NTF only keeps your data on file for the purposes of keeping records for accounting and administration purposes and will never share your information with anyone outside of NTF, it is exempt from being listed as a data controller on the Information Commissioner’s public register of data controllers. Should you decide to leave NTF and cease membership, your records will be deleted. During membership, only authorised employees or owners of NTF will have access to this data and agree never to divulge any personal details to anyone outwith NTF authorised personnel.
3.2 Privacy
NTF is committed to preserving your privacy and as such will never pass on your data to any thirds parties outwith NTF and its affiliates. (The only exceptions to this would be in a legal case where data was required to be released by law or where a dispute arose amongst members and details were shared amongst the parties involved to try to reach an amicable outcome.)
3.3 Confidentiality Amongst Members
Unless otherwise agreed with NTF, you agree not to divulge any information regarding other members of the service to anyone else. This information may be given to you for the purposes of completing a transaction should any dispute arise to allow members to resolve such disputes amicably without the need for NTF intervention or legal action. This information may be accessible within NTF, i.e. via the website, or given to you by NTF directly via email. Again any passing on of this information or misusing it for purposes such as “junk mail”, spamming or harassment will be considered a complete breach of these T&C and a breach of the law. NTF is completely against these practices and anyone found committing such offences shall be dealt with accordingly, i.e. immediate membership termination. If you know of anyone committing such violations, you should contact the webmaster immediately at admin@notradingfees.com.
4. General Transactions
The layout of the NTF website is such as to provide the user with an easy to use and navigate website where buying and selling of virtual financial products is a straightforward and easy to understand procedure. You will find simple instructions of the buying and selling procedures in the FAQ section.
NB All transactions will be kept completely anonymous unless a dispute should arise which requires the sharing of user data with all necessary parties for the purposes of resolving the dispute.
NTF owns the intellectual property rights, trademarks and copyrights over text, source code and logos and graphics in and related to the NTF website and you accept that you may not use or reproduce any such text, source code or logos and graphics anywhere without the express permission of NTF.

4.1 Trading Fees
As the site name “notradingfees” suggest, there are no fees for making a trade on the site, i.e. no extra costs when buying or selling a virtual financial product. There are also no membership fees. However, NTF reserves the right to change this policy at any time without liability. NTF may introduce trading fees or membership fees without prior notice given to its members. On acceptance of this agreement as part of membership, you the member accept there may be fees introduced in the future to continue membership or to make further trades. All past trades will be exempt from fees. All fees paid to NTF are considered final and non-refundable.
In the future, new services may become available to members which may incur additional fees as stated at the time of using such a service.
All fees are inclusive of VAT unless otherwise stated.
5. Our Responsibilities
5.1 Liability Regarding Transactions and Stock Information
NTF holds no responsibility and cannot be held liable for any unlawful activity in relation to a buyer or a seller of virtual financial products on the NTF website. NTF uses a third-party payment mechanism and all users agree to be bound by that third party’s terms and conditions of use. NTF will not be held liable for any unlawful or fraudulent activities of its members in relation to use of the third-party’s payment mechanism for making deposits and withdrawals from the NTF website and shall be held entirely blameless where legal proceedings arise. Nor does NTF takes any responsibility for the legality, accuracy, value or safety of any financial or stock information provided on the website via RSS feeds or by any other means. Members accept that all information provided on the NTF website is for information purposes only and should not be treated as 100% accurate or up-to-date. Should a member make a transaction on the basis of information found on the NTYF website and later find it to be inaccurate or have reason to feel they made a transaction based on false information, they accept full responsibility for their own decisions regarding trades. The agree to hold NTF totally blameless and agree not to hold NTF liable for any errors on the NTF website.
We would like to inform members that information provided on the NTF website may not be completely current or accurate. Please exercise caution when making a decision to trade based on the information available on the NTF website.
